The R-1 visa is reserved for foreign nationals who are seeking temporary admission to the United States to be employed, at least part-time, as a minister or in another religious vocation or occupation.

  • Initial Stay: 30 months.

  • Extensions:  Up to 30 months, provided the total period of time spent in R-1 status does not exceed a maximum of 5 years.

  • Maximum Stay: 5 years (unless residing abroad and physically present outside of the U.S. for 1 year).

  • Petition Process: Employer files Form I-129 with attestation and supporting documents.

    • Cannot self-petition.

  • Premium Processing: Only available for Petitioners who have previously completed a successful on-site inspection at the location where the beneficiary will be employed.

    • $460 (I-129 Filing Fee); 

    • $1,440 (I-907 Premium Processing Fee); and/or

    • $190 (DS-160, Online Nonimmigrant Visa Application)

  • Timeline: Varies. See USCIS Processing Times website for most up-to-date information. 

  • On-Site Inspections: Conducted by the Fraud Detection and National Security ("FDNS") directorate of the USCIS conducts on-site inspections of I-129 petitions to determine whether the petition is fraudulent.
