EB-1C multinational executives and managers

The EB-1C employment-based preference category is reserved for multinational executives and managers. Although no labor certification ("PERM") is required, the petitioning U.S. employer must provide a job offer in the form of a statement describing the duties of the proffered position and the capacity in which the beneficiary will be employed. 

 

In order to establish eligibility for EB-1C classification, the petitioner must submit documentary evidence to establish that:

 

  1. The beneficiary was employed outside of the United States for at least one (1) year in the three (3) years preceding the filing of the EB-1C petition by a firm, corporation, affiliate, subsidiary, or other legal entity of the U.S. petitioner;

  2. The beneficiary's employment abroad was in a managerial or executive capacity;

  3. The beneficiary seeks to enter the U.S. to continue to render services to the same employer, affiliate, or subsidiary thereof in a managerial or executive capacity; and

  4. The U.S. petitioner has been "doing business" in the United States for one (1) year.
